The iGuest Visitors' Check-in Register has been drawn up to include the legal requirements of Section 7 of the Immigration Act, 2002 (Act No. 13 of 2002), as detailed under Section 40 of the Immigration Amendment Act.
In this act it requires that every person in charge of any premises, whether furnished or unfurnished, where lodging or sleeping accommodation is provided for payment or reward, shall, keep a register of all persons provided with lodging, and every person shall sign the register and furnish the prescribed personal particulars.
Failure to keep a detailed record of your guests would be breaking the law, and would make you liable for prosecution and a possible fine. |
In addition, due to the nature of the law, it is an increasingly accepted requirement for all professional industries to protect themselves against potential liability. The iGuest Visitors' Check-in Register includes a legally drafted disclaimer which will assist in protecting you against Third Party claims in cases where you or your staff are not negligent in causing injury, loss or damage by a guest or patron.
This protection is becoming more important given the number of foreign tourists visiting South Africa and the current levels of crime in the country. It is the responsibility of the establishment owner to ensure the acceptance of validity and legality of this publication from your insurance company and/or your legal advisor. |
The iGuest Visitors' Check-in Register would also satisfy the requirements of most insurance companies as it fulfils their basic conditions, and failure to keep complete records could render cover invalid.
